Terms and Conditions
These terms and conditions apply to all offers, quotations, deliveries and agreements. These terms and prevail over the conditions of the client.
The Metaalunie conditions apply to our assignments, which include the following article:
Article 22: Applicable law and competent court
22.1. Dutch law applies.
22.2. The Vienna Sales Convention (CISG) does not apply, nor does any other international regulation that may be excluded.
22.3. The Dutch civil court with jurisdiction in the Contractor’s place of business is authorized to take cognizance of any disputes. The Contractor may deviate from this rule governing jurisdiction and rely on the statutory rules governing jurisdiction instead.
These Terms and Conditions constitute a comprehensive translation of the Dutch version of the Terms and Conditions of the Metaalunie as filed with the Registry of the Court of Rotterdam on 1 January 2019. The Dutch version will prevail in the explanation and interpretation of this text.

Special clause COVID/Corona
Quotations are made subject to force majeure due to the Coronavirus. This means that in case of delays in the delivery of materials by suppliers, due to the loss of capacity at our company and/or our subcontractors, as well as exceeding(s) of delivery times, we are not liable for any resulting damage and will not owe you or any other compensation.
We will of course do everything we can to prevent this as much as possible and we will inform you about changes as soon as possible.
- All our quotes are subject to availability.
- Rental prices are based on a minimum rental period of 4 months.
- Rent is charged every month, at the end of the month.
- Rent is charged per calender day.
- Payment within thirty days.
- Rental period starts when track leaves our site in Hem NL and ends after returning at our site in Hem NL.
- Freight rates, including loading and unloading costs, are charged to you separately.
- We rent out clean equipment and would like to return it clean. If not returned clean and undamaged, our cleaning costs and repair costs will be charged to you separately.
- Our prices are fixed for the rental period agreed upon with you and exclude the applicable VAT.
- If an order is canceled within 31 days before the first scheduled delivery date, the client is obliged to pay the amount equal to the rent for 31 days, without the rights to compensation of the full damage amount.

Prices
We use prices per m1 Kreicom Crane track. Prices depend on type.
(Track per one metre: for 12 metres track 2 beams with rail of 12m1 are used.)
Please ask us for a quotation specifically for your construction site.
We will ask you to inform us about the type of crane, the surface (Kreicomplates), the location of the construction site and the duration of the rental period.
Also please note the combination "Crane track in combination with Kreicom plates". Possibly the use of track together with Kreicomplates is an economical solution for your construction site.

Further conditions:
(Track per one metre: for 12 metres track 2 beams with rail of 12m1 are used.)

We will ask you to inform us about the type of crane, the surface (Kreicomplates), the location of the construction site and the duration of the rental period.
Also please note the combination "Crane track in combination with Kreicom plates". Possibly the use of track together with Kreicomplates is an economical solution for your construction site.
All our quotions are subject to availability. Please ask for this in time.
Further conditions:
- Prices listed are based on a minimum rental period of 4 months.
- The rent is charged at the end of each month.
- Payment within thirty days.
- The rental period commences when the track is delivered on your location and ends when the track is returned to our site.
- Netting is per calender day.
- Freight rates including costs of loading and unloading will be charged to you separately.
- We rent out clean materials and would like them to be clean when returned. Should this be impossible, then our cleaning costs will be charged to you separately.
- Our prices are fixed for the agreed upon construction site and period.
- On all our quotations, orders and to all agreements concluded with us, the terms & conditions of "metalunion" are applicable. Upon request these terms can be sent to you.
